Bill C-300 Marches on Mining

A brief note to note that Bill C-300 marches on. At this link is another new exhortation to pass the bill and the news that:

Bill C-300 is presently being considered by the standing committee on foreign affairs and international development. That process is scheduled to end on June 10, but there is the possibility of a 30-day extension if the committee members agree. However, regardless of any extension, time is obviously getting short in which to have input with the standing committee and, more crucially, to prepare for the big event of third reading. Already groups such as the Prospectors and Developers Association of Canada have urged their members to lobby against “this potentially disastrous piece of legislation”.

I too must bring this to the attention of any members of the Canadian mining community who are not already aware of this bill (if that is possible) and urge them to work together to defeat what, in my opinion, would be a disastrous piece of legislation. In other postings in this blog, I have noted my concern that a mining company could be accused in secret and tried in the dark, back rooms of Ottawa by political appointees or, worse, career bureaucrats, and found guilty without the benefit of due process. I have noted concerns that a slew of frivolous complaints will be lodged against mining companies by assorted folk with suspect agendas. And the mining companies will be forced to fight fights without the protection and procedures of the law courts.

In short this bill would take us back to the dark ages of the Star Chamber and mob rule. It is insane that Canada can contemplate extra-judicial procedures that would enable every populist leader, every misguided NGO, every church priest seeking attention for his failing religion, every camera queen gloating a moment of glory in the spotlight, all to transcend national law, and all in the name of social justice in countries too corrupt or inept to manage their own affairs.

Let those supporting the bill rather get on a plane (buying a carbon credit before departing) and go to the ill-ruled countries and work there to install decent government. Let them work there to dispossess those who possess and refuse to share with others the opportunities their countries offer. They would achieve more that way, even though it would be less comfortable than sitting in Ottawa pontificating.

The link to which I pointed you above makes reference to the movie Avatar as a good example of why the bill is needed. The report says:

And certain journalists are waxing lyrical in their opposition. Consider the following Avatar comparison from Peter Koven of the Financial Post:

Picture this scenario: A sinister mining company travels to a faraway land and with the help of a psychotic militia, it rapes the land of its natural beauty and slaughters its eco-loving inhabitants.

That is the plot of Avatar, the highest-grossing movie to date. Koven suggested that the allegations made during hearings on Bill C-300 paralleled this plot!

If ever there was a good reason to kill the bill, it is this: reference to Hollywood movies as a reason to change Canadian law and toss away sovereign rights by opening the door to every minor place with a gripe on its lips. The very idea that supporters of the bill revert to movies as a basis to plead their case, in my mind, undermines their credibility, their reason, and their logic. If they can come up with no better justification for extra-legal procedures than a money making movie, they must be branded intellectually and spiritually bankrupt.

So if as a member of the mining industry you have not already moved to kill this bill, now is the time to move. And go buy a copy of Avatar to sent to the NGOs to console them.
